THESE TERMS OF SERVICE CONTAIN A BINDING ARBITRATION REQUIREMENT AND CLASS ACTION WAIVER THAT IMPACT YOUR LEGAL RIGHTS TO RESOLVE DISPUTES UNLESS YOU OPT OUT. PLEASE READ CAREFULLY.

Clout Nation, LLC, along with its subsidiaries and affiliates (collectively, "Clout Nation" or "we"), provides the Clout Nation website, mobile applications, and other online products and services.

These Terms of Service inform you of the general terms that you agree to when using our Services. Some of our Services may have additional terms that apply specifically to that Service. These Terms of Service, together with any additional specific Service terms, are collectively called the “Terms.” By using any of the Services, you acknowledge that:

  • You are entering and using this site at your own free will.

  • You agree to be bound by the Terms.

  • Clout Nation shall not be held liable for any consequences arising from your use of the Services.

If you do not agree to these Terms—including the mandatory arbitration provision (see “DISPUTES-ARBITRATION” below) or our Privacy Policy—do not access or use the Services.

AUDIENCE AND ACCOUNTS

  • You must be at least 18 years old to register for the Services.

  • You must be at least 13 years of age in the U.S., or 16 years of age in countries subject to the EU General Data Protection Regulation (GDPR), unless exempted by country-specific exceptions.

  • If you are between 13 (or 16 under GDPR) and 18, you may only use the Services under the supervision of a parent or legal guardian who agrees to be bound by these Terms and our Privacy Policy.

  • Do not register or provide any personal information if you are under the required minimum age.

  • If we learn we’ve collected personal data from a child under the required age, we will delete it promptly. If you believe this has occurred, please contact us using our contact form.

By using the Services, you agree to:

  • (a) Maintain the security of your account by not sharing your password or access credentials.

  • (b) Restrict access to your account and your computer or mobile device.

  • (c) Promptly notify Clout Nation if you suspect any security breach.

  • (d) Take full responsibility for activities under your account and accept all risks of unauthorized access.

  • (e) Comply with these Terms and the Community & Content Policy.

Note: You are responsible for all data charges incurred by using the Services.

YOUR USE OF THE SERVICES

You agree not to violate any law, contract, intellectual property rights, or third-party rights while using the Services. You are solely responsible for your behavior and accept all associated risks.

You agree not to:

  • Use the Services in ways that inhibit others or impair functionality.

  • Engage in conduct that is discriminatory, defamatory, hateful, harassing, obscene, threatening, or otherwise objectionable.

  • Falsely claim affiliation with Clout Nation or imply endorsement.

  • Send unsolicited advertising or promotional material.

  • Attempt to reverse engineer, manipulate, or interfere with the Services.

  • Use another user’s account without authorization.

  • Develop third-party apps that interact with the Services without written consent.

  • Use bots, crawlers, scripts, or other automated means to access or manipulate the Services.

USER CONTENT

By creating an account, you grant Clout Nation full rights of ownership to:

  • Any pictures, videos, music, or other media you upload.

  • Any posts or content created within the platform.

These rights include reproduction, modification, publishing, and distribution of your content for use in connection with Clout Nation’s services and promotion.

Note:

  • You retain the right to delete your account and content at any time.

  • Previously posted media may remain in our system unless explicitly requested for removal.

You may post content (messages, text, photos, videos, etc.) only if it:

  • (a) Is non-confidential.

  • (b) You own or have permission to post.

  • (c) Includes written consent of identifiable individuals shown.

  • (d) Is accurate and not misleading.

  • (e) Complies with these Terms and applicable laws.

Prohibited: Content that violates these Terms, infringes intellectual property, contains false info, or is inappropriate.

COPYRIGHT COMPLAINTS

Clout Nation respects intellectual property. If you believe your work has been copied or used in violation of copyright law:

HOW WE RESPOND TO VIOLATIONS

Clout Nation reserves the right to:

  • Monitor your use of the Services to prevent abuse.

  • Investigate violations and report to law enforcement if necessary.

  • Use collected data to improve the Services.

Clout Nation is not liable for:

  • Illegal activity, damages, losses, or outcomes from your use.

  • User-generated content, conduct, or interactions.

  • Direct, indirect, incidental, consequential, or punitive damages.

By using the Services, you agree to:

  • Release, indemnify, and hold harmless Clout Nation and its affiliates from any claims or losses resulting from your use or violations of these Terms.

We reserve the right to:

  • Remove content that violates these Terms.

  • Suspend or terminate accounts at any time.

  • Restrict or block access to the Services without notice.

Repeat offenders (notified twice for violations) will be permanently banned.

PRIVACY POLICY
